CONTRACT FOR USE OF THE E-SHOP OF ELMERO PROJECT LP Company No.SL022814
Elstore office located 35 CLAVERHOUSE DRIVE, EDINBURGH, UNITED KINGDOM, EH16 6BX, United Kingdom and the customer, who places the order in the e-shop of ELMERO PROJECT LP Company No.SL022814 and identifies himself or herself by entering his or her personal data in the order form (hereinafter the Service User and/or Buyer).
1.1ELMERO PROJECT LP Company No.SL022814 (hereinafter the E-shop) is an online shop for the purpose of selling products to Service Users.
2. GENERAL PROVISIONS
2.1 The contracting parties shall be governed, in their mutual relations, by the Law of Obligations Act and other laws and legal acts of the United Kingdom, as well as the provisions of the Contract for Use of the E-shop.
2.2 The Service Provider shall have the right to introduce changes in the offered E-shop service at any time.
2.3 The Service Provider shall have the right to unilaterally amend the terms and conditions of the Contract of Use without being obliged to notify the Service User thereof in writing by e-mail.
3. PRODUCTS AND THE PURCHASING PROCESS
3.1 As a rule, the products displayed in the E-shop are available in stock.
3.2 Where the product is out of stock and the order cannot be served straight away, a customer service member of the E-shop shall contact the Service User and offer a new term for the delivery of the product, replacement of the product with an equivalent product of the same price and quality, or a full refund. The Service User shall be refunded immediately, but not later than within 30 days after placing the order.
3.3 The product images displayed serve as an illustrative example and may differ from the actual product. The product descriptions provided in the E-shop may not be exhaustive, and may contain unintentional errors.
3.4 The products offered in the E-shop shall be sold to natural persons.
3.5 The Service User confirms being at least 18 years old to have credit card orders.
3.6 The Service User shall select the desired products, enter the required data for placing the order (surname, first name, contact telephone number, contact e-mail address, delivery address, postal code), and make the payment for the products.
3.7 The Service User is obliged to provide truthful information required for the fulfillment of the order. The Service Provider shall not be held liable for failure to serve the order due to incorrect information provided by the Service User, or for any consequences thereof.
3.8 The sale shall be effected when the Service User has placed an order via the E-shop website or by telephone to customer service, and has paid for the order.
3.9 The warranty period is 12 months from the date of purchase.
4.1 All prices in the E-shop have been denominated in USD and not include the value added tax and/or other taxes applicable in Buyer’s delivery country.
4.2 The Service Provider shall have the right to change the prices displayed in the E-shop at any time. Where the E-shop prices have been changed after the Service User has placed an order and paid for the order, the Service Provider shall be obliged to deliver the corresponding products to the Service User at the price valid at the moment when the order was placed.
5. TERMS OF DELIVERY
5.1 The goods shall be delivered to the Service User by post.
5.2 As a rule, the goods shall be delivered to the Service User within 5 to 14 working days after transfer of the Service User’s payment to the Service Provider’s bank account. Delivery times may vary, especially during peak periods.
5.3 International items may be subject to customs processing and additional charges. International Shipping – items may be subject to customs processing depending on their declared value.
As the buyer, you should be aware of possible:
– delays from customs inspection
– import duties and taxes which buyers must pay
– brokerage fees payable at the point of delivery.
Before confirming the order, please make all clear and if needed please contact your country’s customs office to have more detailed information.
5.4 The order shall be cancelled, if the payment has not been transferred to the Service Provider’s bank account within five (5) working days after the order was placed.
6. WITHDRAWAL FROM CONTRACT
6.1 Should the Service User wish to withdraw from the contract after the order has been placed and before the contract has been performed by the Service Provider, the Service User shall inform the Service Provider in writing thereof as soon as possible. The written notice shall be sent to the e-mail address firstname.lastname@example.org. The e-mail shall contain the number of the order which the Service User wishes to cancel, as well as the contact data on the Service User (first name, surname, date of the order, contact telephone).
6.2 Where the application for withdrawal is delivered to the Service Provider after performance of the contract by the Service Provider, the withdrawal from the contract shall be governed by the “Right to return goods” chapter of the Contract for Use of the E-shop.
6.3 The Service Provider shall refund the amount paid by the Service User immediately, but not later than within 30 days after receiving the application for withdrawal from contract.
6.4 The refund shall be transferred to the same current account which was used for payment of the amount to the Service Provider.
7. RIGHT TO RETURN GOODS
7.1 All goods purchased from the E-shop may be returned within 30 days.
7.2 The product shall be returned in perfect condition, complete and unused, in the original packaging.
7.3 The right to return goods shall not apply to products the characteristics of which do not allow to preserve the product in perfect or unused condition.
7.4 To return a product, a notice of return shall be submitted to the e-mail address email@example.com.
7.5 Upon withdrawal from contract, the Service User shall return the purchased product immediately, but not later than within 30 days after applying for withdrawal from contract.
7.6 The Service User shall be refunded immediately upon return of the product, but not later than within 30 days after the product was returned.
7.7 The refund shall be transferred to the same current account which was used for payment of the amount to the Service Provider.
7.8 The Service User is obliged to bear the costs related to the return of the goods, except where the product returned did not comply with the Service User’s order.
7.9 Where it becomes evident, after the return of the product, that the product does not meet the conditions stipulated in clauses 7.1 to 7.4 of the Contract for Use of the E-shop, no refund shall be provided to the Service User, with the returned product thus retained by the Service Provider. The Service User shall bear any expenses related to the storage of or return of the product to the Service User.
8. PERSONAL DATA AND USE OF PERSONAL DATA
8.1 The Service User shall grant the Service Provider an express and enlightened consent to the processing of the Service User’s personal data.
8.2 The Service User’s personal data, which were made available to the Service Provider via entry of the data upon submission of the order, shall be entered in the customer register and used for providing the sales service and for posting sales offers to the Service User.
8.3 The customer relationship arising from the registration of the order in the E-shop shall be the source of personal data.
8.4 The personal data subject to registration shall include the data on the Service User’s order – personal identification code, surname, first name(s), apartment number, house, street, settlement or city, postal code, telephone number, address, date of birth, sex, terms of delivery, method of payment, consent to the terms and conditions of the Contract for Use of the E-shop, consent to the sending of sales offers, any comments posted as free text to the e-mail address.
8.5 The Service User’s personal data required for mediation of goods to the Service User shall be forwarded to the postal service providers.
8.6 The personal data are protected by all security measures provided by law.
8.7 The Service Provider undertakes not to forward registered personal data to unauthorized third parties.
8.8 The Service Provider shall retain the right to forward the Service User’s personal data to third parties authorized by law to process the data for the fulfillment of an obligation provided by law, and to third parties authorized to access such data for the protection of the life, health or freedom of the Service User or other individuals.
8.9 The Service User shall have the right to review the personal data concerning the Service User, as well as to change these data or to request deletion of the personal data from the register.
8.10 The Service User shall grant the Service Provider consent to the submission of the order confirmation to the e-mail address entered when placing the order.
8.11 The Service User shall grant the Service Provider consent to posting sales offers to the e-mail address entered when placing the order, provided that the Service User has agreed to receive such sales offers by ticking the corresponding box in the window where the order was placed.
9.1 The Service Provider shall be liable for the product within the extent of the sales price of the product.
9.2 The Service User is obliged to use the E-shop service only in accordance with the law and good practice.
9.3 The Service User shall bear any expenses related to the acquisition and maintenance of the software data communication systems required for the use of the devices, as well as for any other expenses related to the use of the E-shop service.
9.4 The Service User shall be fully liable for any damage caused to the Service Provider, other Service Users or third parties through use of the E-shop in breach of terms and conditions of the Contract for Use of the E-shop or in violation of the law or good practice.
10. CONDITIONS OF USE
10.1 The Service User is obliged to familiarize himself or herself with the terms and conditions set forth in the Contract for Use.
10.2 By ticking the “I accept the terms and conditions of use of the e-shop of
ELMERO PROJECT LP Company No.SL022814” box in the corresponding window when placing the order, the Service User confirms that the Service User has reviewed, understands and accepts the terms and conditions of the Contract for Use.
11. SETTLEMENT OF DISPUTES
11.1 Any disputes arising from the Contract for Use of the E-shop between the Service User and the Service Provider shall be settled in accordance with the legal acts valid in the Country of Estonia. Where the parties fail to reach an agreement, the parties shall have the right to settle the dispute in court.
